Trey Gowdy Blasts the Double Standard in Trump and Biden Classified Documents Cases

Former South Carolina Congressman Trey Gowdy broke down the double standard at work regarding special counsel Robert Hur’s testimony to Congress and his decision to not charge Joe Biden with stealing classified documents versus Jack Smith trying to ensure Donald Trump dies in prison over similar offenses.

As a former federal prosecutor, Gowdy explained to Fox News’s Martha MacCallum that there were only three options as to why Hur didn’t bring charges against Biden.

The first, Gowdy explained, is that Joe Biden is too mentally incompetent to stand trial or participate in his legal defense.

Second was that Hur lacked the evidence to prove the underlying offense.

And the third and final option was that Hur actually did find Biden to be of sound mind and possessed the necessary evidence to go to trial, but did not think the case could win in front of a jury.

Gowdy then went on to compare the underlying reason for the investigations into both Trump and Biden which was over the willful retention of classified documents.

According to Gowdy, there was a clear double standard where Biden’s Justice Department let Joe Biden skate by while trying to jail the leading presidential opposition on the same charges.

“But in terms of the retention, the willful retention, I said months ago, treat them exactly the same.”

Gowdy added that “my position has not changed, but the DOJ is not treating them the same.”

Gowdy also went a step further and said the facts in the case against Biden were far more damning than those against Donald Trump.

“If I were a prosecutor, I would rather have the facts in Joe Biden’s case,” Gowdy stated.

Gowdy said Biden hid stolen classified documents in “multiple locations over an extended period of time, and denials with consciousness of guilt.”

What Gowdy meant by “consciousness of guilt” is the fact Hur uncovered audio evidence of Joe Biden telling the ghostwriter for his memoir that he kept classified documents in the basement of his Delaware home.

The audio also contained Biden reading from the classified documents.

MacCallum then played Gowdy a clip of Democrats during Hur’s testimony claiming what Donald Trump had done was far worse.

Gowdy scoffed and doubled down on his argument by saying the underlying facts were far more incriminating against Joe Biden than Donald Trump.

“If I were a prosecutor, I’d rather have the facts against Joe Biden than Donald Trump,” Gowdy concluded.
